Presidential Litigation

At the request of the Green party, I submitted a brief as amicus curiae (friend of the court) in case of The Arkansas Educational Television Commission v. Ralph P. Forbes. Argument was held October 8, 1997. This case will determine the right of public sponsors of candidate debates to pick and choose who may participate. It is related to the issues I discussed in an article I wrote for the National Law Journal last year. See Debates Need Minor Players, National Law Journal, October 21, 1996.

In 1996, we filed an application to intervene in an action brought by Ross Perot who was seeeking the right to appear in the Presidential debates. The District Court's initial determination was to deny intervention but accept the papers as amicus curie.
